Contest rules and regulations:

All photos must be original work, taken by the entrants. No third party may own or control any materials the photo contains, and the photo must not infringe upon the trademark, copyright, moral rights, intellectual rights, or rights of privacy of any entity or person.

• The photo must be in its original state and cannot be altered in any way, including but not limited to removing, adding, reversing, or distorting subjects within the frame.

• Violators will be removed from the contest, stripped of any prize(s), and banned from entering future contests.

• Entries will not be accepted unless submitted via the official contest channel. Entries not submitted through the proper channel will be deleted.

• The winner will be determined by the NASWA Resort. All decisions are final. The NASWA Resort reserves the right to disqualify any entry that is deemed inappropriate or does not conform to stated contest rules.

• By entering the contest, entrants agree that photos submitted can be used by the The NASWA Resort for advertising, informational or marketing purposes, and may be redistributed via online, print, or social media..

• Submissions will not be accepted once the deadline lapses.

• The prize must be collected by the winner and is nontransferable to other parties.

• The winner will be contacted via the email address provided during entry. If no response is received after 5 (five) business days, a new winner will be selected and the previous winner will forfeit all rights to the prize.

• The contest is void where prohibited or restricted by law.

• No purchase is required to enter this contest. 

1) Contest Description: The NASWA Resort is sponsoring a photo contest where entrants will submit photos of their favorite NASWA memories, which have not been; previously published in any form, pending publication, are submitted for publication during the Contest Period, or have won any other contest or competition. In the two weeks following May 31, 2020, the NASWA will choose the winning photograph, and announce the winner.

2) How to Enter: Your completed Contest Submission will consist of the required fields in the form on the NASWA website as well as an original photograph that the entrant has explicit permission to use.

3) Contest Period: The contest begins May 1, 2020. Entries must be submitted by 11:59pm on May 31, 2020.

Judging completed and winner determined on or about June 20, 2020 

4) Eligibility: Contest is open to people 18 years of age or older. Employees, officers and representatives (and members of their immediate families and those living in the same household of each) of the NASWA Resort and it’s subsideraries, affiliated companies, advertising and promotion agencies and any company involved in the design, execution, production or judging of this promotion (“contest entities”) are ineligible. Void where prohibited or restricted by law.  

5) Number of Entries and Disclaimer of Liability Regarding Entries: You may enter the Contest an unlimited number of times during the Contest Entry Period, but note that you may only win once and each entry must be substantially and creatively different. Sponsor is not responsible for lost, stolen, broken, misdirected or late submissions. Sponsor assumes no responsibility for any problems, errors or failures of any kind due to computer system, phone line, hardware, software or program malfunctions, delayed computer transmissions or network connections that are human or technical in nature. Entries that contain unsuitable content or that are in violation of third party rights (including, but not limited to, copyrights) will be immediately disqualified. Sponsor retains sole discretion as to what constitutes unsuitable content and will not be liable in any way for disqualified entries. Sponsor also reserves the right not to determine a winner if there are not adequate responses or entries of suitable quality.

6) Contest  Winner Determination:  Contest Submissions will be judged by members of the NASWA Resort Team. The decisions of the NASWA Resort Team in all matters relating to this Contest are final and binding. Odds of winning will depend on the number of eligible entries received for the entire promotion period.

7) Prizes:  The Contest Winner will receive a 7-day, six-night stay at the NASWA Resort in an available 2 Bedroom Cottage.  Prizes cannot be assigned and there are no cash substitutions. Blackout dates apply. Booking is subject to availability restrictions, and availablity at any given time is not guarenteed.

Winners will be contacted by phone or mail within three (3) business days of the conclusion of winner determination.

Potential Winners will be required to complete an Affidavit of Eligibility and a Liability/Publicity Release (“Affidavit”). The Affidavit must be returned within five (5) days of Sponsor’s provision of this document.  Potential winners will also be required to send a copy of their passport, driver’s license, birth certificate or other appropriate documentation (acceptable to Sponsor) as proof of age and residency.

Non-compliance with any of these requirements may result in disqualification, in which case an alternate winner may be chosen.  Return of prize notification, Affidavit/Release as undeliverable will result in disqualification and an alternate winner will be named. All entrants agree to comply fully with each provision in these Official Rules.  Any person attempting to defraud or in any way tamper with this Contest and any person who does not comply with these Official Rules, will be ineligible

8) General:  If for reasons beyond the Sponsor’s control, the Contest is not capable of running as originally planned, the Sponsor, at its sole discretion, reserves the right to cancel or modify the Contest, without liability and to the extent feasible, will determine winners and award prizes among entries received prior to cancellation or modification. Sponsor is not responsible for lost, late, misdirected, damaged Contest Submissions. Contest Submissions which are illegible, incomplete, inaccurate, irregular, or otherwise not in compliance with these Official Rules, are also void.

9) Right to Use Your Contest Submission and Information About You: By submitting a Contest Submission you: (a) represent and warrant that your Submission and the photo contained therein is original, not previously published, and does not incorporate or include anything that is owned by any third party or would require the consent of any third party and your Contest Submission does not violate any copyright, trademark, publicity right, privacy right or any other right of any third party; (b) automatically grant to the Sponsor, a non-exclusive, world-wide, irrevocable license to use, reproduce, create derivative works from, modify, publish, edit, translate, distribute and display your Contest Submission or the photo contained therein; (c) agree that upon selection as a winner of any prize, you agree that your Contest Submission shall legally be considered a “work made for hire,” with all rights therein, including, without limitation, the exclusive copyright, transferred to and being the property of the Sponsor; (d) agree that upon selection as a winner of any prize, in the event your Contest Submission is considered not to be a “work made for hire,” you irrevocably assign to the Sponsor, all right, title, and interest in and to your Contest Submission and the photo included therein, in any and all media whether now known or hereafter devised, in perpetuity, anywhere in the world, with the right to make any and all uses thereof, including, without limitation, for purposes of advertising or trade; and (e) agree that upon selection as a winner of any prize, you grant to the Sponsor the right to utilize your Contest Submission including the photo included therein in any of it’s product or marketing ventures without any compensation. The rights granted under this paragraph shall extend to the Sponsor, its affiliated companies with respect to all entries and all other submitted materials related to the Contest, including those submitted by non-winners and winners.

By submitting an Entry, you grant to the Sponsor and its affiliated companies the right to use your name, likeness, picture, address (city and state), voice, biographical information, the photo in your Contest Submission, and to create and use stylized photographs of the photo in your Contest Submission for advertising and promotional purposes in promoting or publicizing the NASWA Resort and its products or services, without compensation. You shall have no right of approval, no claim to compensation, and no claim (including, without limitation, claims based on invasion of privacy, defamation, or right of publicity) arising out of any use, blurring, alteration, or use in composite form of your name, picture, likeness, address (city and state), biographical information, Contest Submission or the presentation of your photo. The rights granted under this paragraph shall extend to the NASWA Resort, and its affiliated companies with respect to all entrants in the Contest, including non-winners and winners. The Sponsor, however, does not have any obligation to use the winning Contest Submissions for any purposes.

10) Release of Liability and Issues of Law: By participating all entrants release the NASWA Resort, its affiliates, partners, subsidiaries, officers, directors, agents, employees and all entities associated with the development and execution of this promotion from any and all liability with respect to and in any way arising from participating in this promotion, acceptance or use of prizes.  Entrants also agree that the NASWA Resort, its affiliates, partners, subsidiaries, officers, directors, agents, employees and all entities associated with the development and execution of this promotion are not responsible or liable for any injury or damage to an entrant’s or third person’s computer related to or resulting from the Contest, the Entries and/or its prizes. The NASWA Resort, their affiliates, partners, subsidiaries, officers, directors, agents, employees and all entities associated with the development and execution of this Contest are not liable for damage to a user’s computer system (including, without limitation, any server failure or lost, delayed or corrupted data or other malfunction) due, either directly or indirectly, to an entrant’s participation in the Contest or downloading of information in connection with the Contest. 

All Federal, state and local laws and regulations are applicable. THE NEW HAMPSHIRE COURTS (STATE AND FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY CONTROVERSIES REGARDING THE CONTEST AND THE LAWS OF THE STATE OF NEW HAMPSHIRE SHALL GOVERN THE CONTEST. EACH ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THOSE COURTS AND HEREBY SUBMIT TO THE JURISDICTION OF THOSE COURTS.  The Contest is void where restricted or prohibited by law.
